By donating, you are agreeing to our terms and conditions including our non-refund policy. Please review the following prior to making your donation in regards the purpose and use of funds you donate.

Unilateral Contract with Aston Villa FC players and Manager

The Blackbridge Sports Group Pty Ltd of Level 26, 44 Market Street, Sydney, NSW, Australia, agree to hold and pay in accordance with these Terms and Conditions, the net proceeds, being the aggregate of all donations received on our platform net of any service fees, transaction fees, costs, outgoings and expenses and the retained amounts for the Charities, are to be held for all the players (including the manager) in equal proportions, that are named on the official match day team sheet of Aston Villa Football Club, of Villa Park , Birmingham, B6 6HE, United Kingdom (“Aston Villa”) for the English Premier League Match vs Manchester City , to be played at the Etihad Stadium, on Sunday 22 May 2022 (“the match”).

The Brighton players and manager so named, shall only receive the net proceeds of funds donated, should the official result at full time of the match, including any match review outcome thereof, if the official match result is a draw or a win for Aston Villa. No further claims will be made against us on any basis. The net proceeds will be paid on an immediately payable basis and no later than 29 May 2022 (UK time).

A running balance of the net proceeds to be paid to the Aston Villa players and manager will be continually updated on the www.lfcchampions.com website. The net proceeds as at full time of the match are the subject of the unilateral contract offer the Aston Villa players and manager named on the official team sheet for the match. Should Aston Villa not draw or win the match, they have no claim on any basis under this unilateral contract offer or otherwise.

We reserve the right, at our sole discretion, to change or modify portions of these Terms and Conditions at any time so far as they relate to donors. If/when we do this, we will post the revised Terms and Conditions on this page and will indicate the date of such revision. Your continued use of the Services after the date of any such changes constitutes your acceptance of the new Terms and Conditions.

Should Aston Villa not be able to draw or win the match, we will pay the net proceeds to i) the Sean Cox Foundation ii) the LFC Foundation and iii) the Steven Gerrard Foundation in equal proportions (“the Charities”).

Role and Services

The service we are providing is of an administration service of collecting funds via an online platform. We are not in any way a broker, financial institution, a debt collector or charity or any organisation similar thereto.

We expressly disclaim any liability or responsibility for the outcome or success of our administration services.

Payment Options

How to donate

Once you have made your selection you will be guided through the payment process.  We adopt by reference, all terms on www.paypal.com. All funds are to be held in an account that has been verified by Paypal, in which details of our organisation has been provided. The method of payment on the web site is by credit card.  We do not capture or store your credit card details, only the authority from our bank that your credit card payment has been approved, your credit card details are stored by our payment processor in accordance with payment card industry standards.

The cards we accept

We accept Visa, Mastercard and American Express cards via a secure payments system which is linked directly to our bank, who will authorise all credit card payments.

Payment currency

All transactions are processed in UK pounds.

Receipt

Paypal ordinarily issues a receipt with a copy of the payment information received from our Bank for each donation.

Refunds and Warranties

You agree that a certain minimum donation amount may apply, and that all donation payments are final and will not be refunded unless, in our sole discretion, we decide to issue a refund of your donation.

As we are not able to refund, it is important to ensure that you enter your details correctly and accurately. This is because the donations form part of a contract we have as we are offering these amounts to Aston Villa players (including manager) which is continuously tracked, updated and disclosed to these parties.

By donating you warrant that the funds donated are not the proceeds of crime, ill-gotten gains, any unlawful activity, be they suspicious or fraudulent.

Disclaimer of Warranties

Making a donation and your use of our service is entirely at your own determined and calculated risk. To the greatest and fullest extent permitted by law, we exclude and disclaim all warranties, conditions and representations, whether statutory, express, or implied.

Limitation of Liability

To the greatest and fullest extent permitted by law, we (including our associates) will not be liable for i) any indirect, incidental, special, consequential, punitive, or exemplary damages ii) loss of profits or goodwill iii) loss of utility or use or iv) any other intangible losses, whether an action arises in contract, tort, negligence, or other basis, resulting from the i) use or inability to use the service ii) the cost of procurement of substitute goods and services iii) unauthorised access or corruption of data or iv) any other matter relating to the services to the fullest extent permitted by law.

Disputes

The parties will as a condition precedent to any legal action against the other, attempt to resolve any disputes in good faith and by first exhausting all available mediation or arbitration dispute resolution means available.

Indemnity and Release

You agree to release, indemnify and hold us and our affiliates, officers, employees, directors and agents harmless from any and all losses, damages, expenses, including reasonable legal fees, costs, awards, fines, damages, rights, claims, actions of any kind and injury arising out of or relating to your use of the Services, any Donation, your violation of these Terms and Conditions. We have and reserve all rights to conduct a defence of any claims, and that you will indemnify us for all related costs of a defence.

Costs, Expenses and Outgoings and Retained Amounts for Charities

All costs and outgoings including transaction fees for processing donations are our responsibility.

Ten percent (10%) of all donations received will be paid to the Charities as retained amounts. Should Aston Villa not draw or win, the retained amounts paid to the Charities will be constituted of the aggregate of all donations less the service fees, costs, expenses and outgoings set out below.

We reserve the right to up to five and half percent (5.5%) of the total amounts donated to cover our service fees and all costs, expenses and outgoings in providing our administration services including any applicable fees, rates, charges, duties, taxes, imposts, and value added taxes. The net proceeds are constituted by the relevant deductions under this clause and form the amounts being offered to the third parties under this agreement. All amounts in this Terms and Conditions are inclusive of any applicable taxes including VAT/GST.

Privacy Policy

The personal information we hold about individuals is handled appropriately and lawfully.  We have no obligation to retain any data you provide to us. You acknowledge that we reserve the right to delete data with or without notice, and without any liability to you or to any third party for any claims, damages, costs or losses resulting therefrom.

Jurisdiction

The law applying to this Agreement is the law of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of that state and waive any right either of us may have to claim that those courts do not have jurisdiction or are an inconvenient forum.
